The Nature and Status of Critical Questions in Argumentation Schemes.

In this paper we show how dialogue-based theories of argumentation can contribute to the construction of effective systems of dispute resolution. Specifically we consider the role of persuasion in online dispute resolution by showing how persuasion dialogues can be functionally embedded in negotiation dialogues, and how negotiation dialogues can shift to persuasion dialogues. We conclude with some remarks on how persuasion dialogues might be modelled is such a way as to allow them to be implemented in a mechanical or computerized (...) system of dialogue or dialogue management. Keeping a conversation going is the social glue of friendships. The DSM criteria for autism list difficulties with back-and-forth conversation but does not necessitate that all autistic children will be equally impacted. We carried out three studies (two pre-registered) with verbally-fluent school children (age 5-9 years) to investigate how autistic and neurotypical children maintain a conversation topic. We also investigated within-group relationships between conversational ability and cognitive and socio-cognitive predictors. Study 1 found autistic children were more likely than neurotypical controls (...) to give off-topic and generic minimal responses (e.g. ‘mm’, ‘oh’) and were less likely to give non-verbal responses (e.g. nodding or use of facial affect to respond). Nonetheless, the autistic group provided topic-supporting responses 62% of the time, indicating some aspects of conversation topic maintenance are a relative strength. Studies 2 and 3 found large individual differences in topic-supporting conversational responding amongst both neurotypical and autistic children. These were positively related to theory of mind ability and age in both groups. Conversational skills lie on a continuum for the general population and differences by diagnostic group are a matter of degree. Given the importance for peer relationships, we suggest a whole-classroom approach to supporting conversation skills in all children. (shrink)

As with other areas of the social world, academic research in the contemporary healthcare setting has undergone adaptation and change. For example, research methods are increasingly incorporating citizen participation in the research process, and there has been an increase in collaborative research that brings academic and industry partners together. There have been numerous positive outcomes associated with both of these growing methodological and collaborative processes; nonetheless, both bring with them ethical considerations that require careful thought and attention. Knowledge plays an important role in argumentation. Yet, recent work shows that standard conceptions of knowledge in epistemology may not be entirely suitable for argumentation. This paper explores the role of knowledge in argumentation, and proposes a notion of knowledge that promises to be more suitable for argumentation by taking account of: its dynamic nature, the defeasibility of our commitments, and the non-monotonicity of many of the inferences we use in everyday reasoning and argumentation.

This research reports on the current state of ethics and compliance programs among business organizations in the United States. Members of the Ethics and Compliance Officers Association (ECOA), the premier professional association for managers working in this field, were asked to provide in-depth responses to a series of questions covering various elements of their corporate ethics and compliance programs. The findings from this analysis indicate that ethics and compliance programs have multiple components that are implemented developmentally, are influenced by regulatory (...) and legal efforts and have evolved into more sophisticated approaches that include risk assessment and employee performance appraisal. However, these programs remain vulnerable to sufficient resource allocation by the organization to be fully effective. (shrink)

Right now, you are undergoing the conscious experience of reading this text, combined with a shifting background of sensory, emotional, and cognitive coloring. The conscious experience of the reading, together with the accompanying background feel of sensation, emotion, and thought, make up how things subjectively seem to you, how things appear, as best you can tell, from your own unique point of view. Consciousness is at once acutely familiar-it makes up the experienced moments of your waking (and perhaps your dreaming) (...) life. But consciousness also raises deep and interesting philosophical questions, questions about how any mere physical subject could produce such a wonder, and questions about how there could be a seemingly private and isolated spot of personal subjectivity in an objective, impersonal world. Perhaps the challenge of developing a satisfying theoretical understanding of consciousness is beyond us-we've reached the limits of what we can comprehend. Or maybe today's shortcomings are only temporary barriers to an illuminating theory of consciousness, one properly embedding it in our scientific worldview. And possibly we already have the resources for a satisfactory theory from the way we think about things in commonsense terms. This reader provides an entry point for considering these and related theoretical questions surrounding consciousness. This introductory section begins with a brief background survey of contemporary debates on consciousness. It then provides a characterization of the notion of consciousness at issue, and considers why consciousness understood this way might be theoretically problematic. It follows with a survey of some of the major theoretical positions on consciousness, and it closes with a synopsis of the sections of the book. (shrink)

Leveraging, according to David M. Anderson and his colleagues, is both a basic principle of human conduct and the most dominant strategy in recent years that individuals, organizations and countries use to pursue their ends. Although many scholars agree that a crisis of "over-leveraging" caused the financial crisis of 2008-2010, it has not been appreciated that an "over-leveraging" crisis has existed in American politics and the American family system as well. A wide-ranging study of the central concepts in epistemology - belief, truth and knowledge. Professor Armstrong offers a dispositional account of general beliefs and of knowledge of general propositions. Belief about particular matters of fact are described as structures in the mind of the believer which represent or 'map' reality, while general beliefs are dispositions to extend the 'map' or introduce casual relations between portions of the map according to general rules. 'Knowledge' denotes the reliability of such beliefs as representations (...) of reality. Although prediction is one of the key tasks of intelligent brains, it often proves impossible in an unpredictably changing world. Hence, brains often decide what happened retrospectively. This framework of postdiction, the opposite of prediction, stands as an alternative or complimentary framework to prediction. I further show how motor-sensory recalibration demonstrates delay compensation at the perceptual level.

A leading political theorist’s groundbreaking defense of ideal conceptions of justice in political philosophy Throughout the history of political philosophy and politics, there has been continual debate about the roles of idealism versus realism. For contemporary political philosophy, this debate manifests in notions of ideal theory versus nonideal theory. Nonideal thinkers shift their focus from theorizing about full social justice, asking instead which feasible institutional and political changes would make a society more just. Ideal thinkers, on the other hand, question (...) whether full justice is a standard that any society is likely ever to satisfy. And, if social justice is unrealistic, are attempts to understand it without value or importance, and merely utopian? Utopophobia argues against thinking that justice must be realistic, or that understanding justice is only valuable if it can be realized. David Estlund does not offer a particular theory of justice, nor does he assert that justice is indeed unrealizable—only that it could be, and this possibility upsets common ways of proceeding in political thought. Estlund engages critically with important strands in traditional and contemporary political philosophy that assume a sound theory of justice has the overriding, defining task of contributing practical guidance toward greater social justice. Along the way, he counters several tempting perspectives, including the view that inquiry in political philosophy could have significant value only as a guide to practical political action, and that understanding true justice would necessarily have practical value, at least as an ideal arrangement to be approximated. Demonstrating that unrealistic standards of justice can be both sound and valuable to understand, Utopophobia stands as a trenchant defense of ideal theory in political philosophy. (shrink)

The model of clinical ethics consultation (CEC) defended in the ASBH Core Competencies report has gained significant traction among scholars and healthcare providers. On this model, the aim of CEC is to facilitate deliberative reflection and thereby resolve conflicts and clarify value uncertainty by invoking and pursuing a process of consensus building. It is central to the model that the facilitated consensus falls within a range of allowable options, defined by societal values: prevailing legal requirements, widely endorsed organizational policies, and (...) professional standards of practice and codes of conduct. Moreover, the model stipulates that ethics consultants must refrain from giving substantive recommendations regarding how parties to a moral disagreement in the clinic should evaluate their options. We argue that this model of CEC is incomplete, because it wrongly assumes that what counts as the proper set of allowable options among which the parties are to deliberate will itself always be clearly discernible. We illustrate this problem with a recent case on which one of us consulted—a neonate born with trisomy 18 (T18). We try to show that law, policy, and standards of practice reveal no clear answer to the question posed by the case: namely, whether forgoing gastrostomy tube feedings for a baby with T18 is allowable. We suggest there may be other kinds of cases in which it may simply be unsettled whether a given choice falls within the set of allowable options within which consensus is to be facilitated. What should an ethicist do when confronting such unsettled cases? We agree with the facilitation model that an ethicist should remain neutral among the allowable options, when it is clear what the allowable options are. But, in unsettled cases, the role of a consultant should be expanded to include a process of moral inquiry into what the allowable options should be. We end by raising the issue of whether this means an ethicist should share his or her own conclusions or views about the allowability of a given clinical option. (shrink)

James Buchanan often argued that fairness is an obligation toward our equals. If Adam Smith is our equal, then we are under obligation to try to understand him. We see this in Buchanan’s attempts to reformat political economy on the basis of natural equals, a world in which Smith’s street porter does indeed have the same capacity as the philosopher. This shows in Buchanan’s excitement over increasing returns models as well as John Rawls’ Theory of Justice both of which he (...) saw a way to make this view operational. (shrink)

This article examines the efficacy of an ethics discernment process in the organizational context, a practice referred to in the paper as "mission due diligence." This type of ethics discernment is a structured process intended to awaken the ethical concerns that a particular issue raises within moral agents and to give voice, directly and indirectly, to those who will be impacted by, and responsible for, strategic decision making. The efficacy of this particular ethics discernment practice is contingent upon several realities, (...) including, but not limited to 1) the timing in which it is undertaken, 2) the degree of importance and relevance attributed to it, and 3) the skills of the person leading it. This case report examines how this process was used to highlight and address the ethical issues related to a new hiring policy, namely, a mandatory nicotine screening test for prospective employees in the healthcare context. Gibson's ecological approach to depiction is compared with Nelson Goodman's relativist theory of representation. Goodman's commitment to radical relativism and Gibson's to direct realism would make these thinkers unlikely candidates for comparison if Goodman himself had not indicated a substantial body of agreement with Gibson in the area of picture perception. The present study analyzes this agreement through systematic discussion of the following theses: realism in representation is not a function of geometrical optics, physical similarity to what is depicted, or (...) deception; pictures differ in density and articulation from words, so that picturing has no explicit vocabulary; and artists can teach us new ways to see the world. The agreement between Goodman and Gibson has wide-ranging implications for the further development of what might be called a Gibsonian relativism. (shrink)

Over the past two decades, academic economics has undergone a mild revolution in methodology. The language, concepts and techniques of noncooperative game theory have become central to the discipline. This book provides the reader with some basic concepts from noncooperative theory, and then goes on to explore the strengths, weaknesses, and future of the theory as a tool of economic modelling and analysis. The central theses are that noncooperative game theory has been a remarkably popular tool in economics over the (...) past decade because it allows analysts to capture essential features of dynamic competition and competition where some parties have proprietary information. The theory is weakest in providing a sense of when it - and equilibrium analysis in particular - can be applied and what to do when equilibrium analysis is inappropriate. Many of these weaknesses can be addressed by the consideration of individuals who are boundedly rational and learn imperfectly from the past. Written in a non-technical style and working by analogy, the book, first given as part of the Clarendon Lectures in Economics, is readily accessible to a broad audience and will be of interest to economists and students alike. In response to Quinn we identify cladistics to be about natural classifications and their discovery and thereby propose to add an eighth cladistic definition to Quinn’s list, namely the systematist who seeks to discover natural classifications, regardless of their affiliation, theoretical or methodological justifications.

I investigate contemporary Russia's real, but shallow success in implementing two borrowed capitalist institutions—a monetary system and the joint-stock company. Even though money and shares of stock in Russia are exchanged in voluntary transactions, they fail to play the legal roles ordinarily expected of them, resulting in weak corporate governance and nonmonetary exchange. Via a criticism of game-theoretic approaches to institutions in the New Institutional Economics, I argue that the roots of this shallow marketization lie in the distinct social foundations (...) of the transactional and legal roles of money and corporate stock. Arguments drawn from sociological institutionalism then illuminate why Russia displays this limited isomorphism to authoritative international models of market institutions. The article concludes by discussing implications for a third body of institutional theory, historical institutionalism, and the possible broader relevance of the pattern of shallow marketization in contemporary relatively backward countries. If archaic symbolism can be regarded as representative of a dimension of consciousness, the question of interpretation is primary. This chapter debates this question by reference to a hermeneutic developed by the historian of religions and phenomenologist, Mircea Eliade. It outlines Eliade's structural hermeneutic, and suggests its potential as a program for philosophical interpretation. There is a polemic in Eliade's thought which provides the negative foundation for his hermeneutic, namely, the polemic against reductionism. The attempt to understand the sacred as (...) an irreducible form is accompanied by the technical attempt to capture its intentional mode. Eliade has suggested that encounter with the myths and symbols of non‐Western and archaic cultures may “lead to a renewal in the philosophic field, in the same way that the discovery of exotic and primitive arts half a century ago opened up new perspectives in European art”.
